Welcome to TakeMeHomeIT. The terms "we", "us", and "our" refer to TakeMeHomeIT. We operate this store and website (the "Services") to provide you with a suitable shopping experience. Our Services are supported by the Shopify Inc. platform.

ARTICLE 3 - NATURE OF PRODUCTS
3.1. Unique Nature of Vintage Products: All products for sale are vintage, used but valuable items. They are sold primarily for their artistic, historical, decorative, and intrinsic value. As objects with a history, minor defects, signs of aging, or imperfections are to be considered normal and an integral part of their authenticity and charm.
3.2. Electrical and Electronic Components: Any electrical or electronic components present in the items are to be considered untested and not compliant with current laws, unless otherwise and explicitly stated. Such components cannot be used without prior verification, and if necessary, upgrading to compliance, by authorized entities or technicians. Installation must be performed by qualified personnel in accordance with local safety regulations.
3.3. Product Presentation: We strive to offer an accurate presentation of the products. However, the display of colors and appearance may vary depending on the device used. The descriptions and photographs in each product's file fully determine its condition and constitute proof of the item's state.
ARTICLE 4 - ORDERS AND CONCLUSION OF THE CONTRACT
4.1. When you place an order, you are making an offer to purchase. We reserve the right to accept or refuse such an offer at our discretion for any reason (e.g., pricing errors, product unavailability). Your order is not confirmed until you receive our acceptance email.
4.2. Availability: Given the unique nature of each item, every product is available as a single piece. If, due to an error, an ordered product is no longer available, we will promptly inform you, the contract will be considered terminated, and we will issue a full refund of the amount paid within 7 working days, without this entitling you to any form of compensation.
4.3. Personal Use: You declare and warrant that you are making purchases for personal or family use and not for commercial resale or export.
ARTICLE 5 - PRICING, BILLING, AND PAYMENTS
5.1. Prices, discounts, and offers are subject to change without notice. The price charged will be the one in effect at the time the order is placed. Unless otherwise specified, prices do not include taxes, customs costs, or shipping fees, which will be calculated at checkout.
5.2. Customs Duties (Non-EU): For shipments outside the European Union, you are responsible for paying any duties, import taxes, and customs clearance costs. These charges are not included in the order total.
5.3. Customer Obligations: For all purchases, you agree to provide accurate, current, and complete data. You declare and warrant that you are authorized to use the chosen payment method and that the charges incurred will be honored.
5.4. Errors and Omissions: We reserve the right to correct any errors, inaccuracies, or omissions relating to descriptions, prices, promotions, and availability, and to modify, update, or cancel orders based on such errors, even after a confirmation has been sent.
ARTICLE 6 - SHIPPING, DELIVERY, AND RETURNS
6.1. Shipping: The methods, estimated times, and costs are detailed in the Shipping Policy. Delivery times are estimates and are not guaranteed. The risk of loss passes to you at the moment we hand the package over to the carrier.
6.2. Obligations upon Delivery: Upon receipt of the goods, you have the duty to inspect the integrity of the package. In case of damage, it is mandatory to accept by signing with "subject to specific inspection". Failure to add this reservation prevents claims for transport damage from being made.
6.3. Returns and Right of Withdrawal: The return and withdrawal policies are described in detail in the Returns and Refunds Policy, which defines the procedures, costs (borne by the customer), and conditions for a refund.
ARTICLE 7 - WARRANTIES AND LIMITATION OF LIABILITY
7.1 For Consumer Customers residing in the European Union (EU)
7.1.1. As used goods, the Legal Guarantee of Conformity has a duration of 12 months from the delivery of the item. This guarantee covers defects of conformity existing at the time of delivery and is not applicable to defects that appear due to normal wear and tear, improper use, or accidental damage.
7.1.2. The exact state of the item, including its imperfections, is fully described and documented in the product sheet, which you accept at the time of purchase.
7.1.3. Presumption of Decorative Purpose: An item's functionality is guaranteed only if expressly stated in the description. In the absence of such a mention, the item is considered sold for its artistic/decorative value, and the Guarantee of Conformity will not cover aspects related to its functioning.
7.2 For Customers residing outside the European Union (Non-EU) and for non-Consumer Customers (B2B)
7.2.1. Except as otherwise and expressly stated by us, the Services and all products are provided "as is" and "as available", without any representation, warranty, or condition of any kind, express or implied, including all implied warranties of merchantability, quality, fitness for a particular purpose, durability, and non-infringement.
7.2.2. We do not warrant that the quality of the products purchased will meet your expectations.
7.2.3. These limitations apply to the maximum extent permitted by the local laws and regulations of your jurisdiction, whose mandatory rights as a consumer remain unaffected.
7.3 General Limitation of Liability
7.3.1. To the maximum extent permitted by law, in no event shall TakeMeHomeIT, its directors, employees, or affiliates be liable for any direct, indirect, incidental, or consequential damages (including, but not limited to, loss of profits, loss of data, or replacement costs) arising from the use of the Services or the products purchased. Our liability, in any case, shall not exceed the total value of the purchase order.
ARTICLE 8 - INTELLECTUAL PROPERTY AND FEEDBACK
8.1. Intellectual Property: The Services and all their contents (trademarks, texts, images, graphics, logos) are the property of TakeMeHomeIT or its licensors and are protected by copyright laws. It is forbidden to reproduce, distribute, modify, or use any material without our prior written consent.
8.2. Feedback: If you provide us with ideas, suggestions, reviews, or other content ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, and publish such Feedback for any purpose, including commercial purposes.
ARTICLE 9 - TOOLS, THIRD-PARTY LINKS, AND RELATIONSHIP WITH SHOPIFY
9.1. Third-Party Links and Tools: We may provide access to tools or links to third-party websites. We are not responsible for such content or services, and your use of them is at your sole risk.
9.2. Relationship with Shopify: Sales and purchases are made directly with TakeMeHomeIT. By using the Services, you understand and agree that Shopify is not responsible for any aspect of the transactions between you and us.
ARTICLE 10 - PROHIBITED USES
You are prohibited from using the site or its content for any unlawful purpose; to violate any laws or regulations; to infringe upon our intellectual property rights or the rights of others; to harass, abuse, insult, or discriminate; to submit false information; to upload viruses or malicious code; to collect personal data of others; for spam, phishing, or other similar activities. We reserve the right to terminate your access to the Services for violating any of the prohibited uses.
ARTICLE 11 - GOVERNING LAW, JURISDICTION, AND DISPUTE RESOLUTION
11.1. Governing Law: These Terms are governed by and construed in accordance with Italian law.
11.2. Jurisdiction: For any dispute, if you are a "consumer" residing in the EU, the mandatory jurisdiction will be that of your residence or domicile. In all other cases, the exclusive jurisdiction is the Court of Rovigo (Italy).
11.3. Online Dispute Resolution (ODR): If you are a consumer residing in Europe, you can use the ODR platform, provided by the European Commission, for the out-of-court resolution of disputes. The platform is available at the following link: https://ec.europa.eu/consumers/odr/
ARTICLE 12 - FINAL PROVISIONS
12.1. Indemnification: You agree to indemnify, defend, and hold harmless TakeMeHomeIT and its affiliates from any claim or demand, including legal fees, made by any third party due to your breach of these Terms.
12.2. Severability: If any provision of these Terms is deemed to be unlawful or unenforceable, such provision shall be severed without affecting the validity and enforceability of the remaining provisions.
12.3. Entire Agreement: These Terms constitute the entire agreement between you and us and supersede any prior agreements.
12.4. Changes to the Terms: We reserve the right to update or change these Terms at any time. It is your responsibility to check this page periodically. Your continued use of the site after the posting of changes constitutes acceptance of those changes.
